Terms of Use

These Terms of Use ("Terms") govern your use of the Flowmark mobile application ("the App") provided by Zyrix Technologies LLC ("we", "us"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. License

We grant you a personal, limited, non‑exclusive, non‑transferable, revocable license to use the App for your own personal, non‑commercial purposes, subject to these Terms and the App Store Terms of Service.

2. Your account & content

You may use Flowmark without an account, or create one to sync and share. You are responsible for your account credentials and for the content (tasks, lists, names, photos) you create or share. You retain ownership of your content; you grant us the limited rights needed to store, sync, and display it to you and to members of lists you share with.

You agree not to use the App to store or share content that is unlawful, abusive, or infringes others' rights, and not to misuse, disrupt, reverse‑engineer, or attempt to gain unauthorized access to the App or its systems.

3. Subscriptions & purchases (Flowmark Pro)

Flowmark Pro is offered as auto‑renewing subscriptions (monthly and yearly) and as a one‑time Lifetime purchase. Pro unlocks features such as unlimited shared lists, all accent colors, and custom reminders.

• Payment is charged to your Apple ID at confirmation of purchase.
• Subscriptions automatically renew at the then‑current price unless cancelled at least 24 hours before the end of the current period.
• You can manage or cancel a subscription in your Apple ID Account → Subscriptions settings. Deleting the App does not cancel a subscription.
• Current prices are shown in the App and may vary by region. Lifetime is a single one‑time purchase, not a subscription.
• Purchases are processed by Apple. Refunds are handled by Apple in accordance with the App Store policies; we generally cannot issue refunds directly.

4. Reminders & permissions

Features that use notifications, contacts, photos, or your calendar require your permission and are optional. Reminders are delivered by your device; we do not guarantee delivery of any particular notification.

5. Disclaimer of warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non‑infringement. We do not warrant that the App will be uninterrupted, error‑free, or that data will never be lost. Keep your own backups of important information.

6. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid us for it in the 12 months before the claim.

7. Termination

You may stop using the App at any time. We may suspend or terminate access if you violate these Terms. Provisions that by their nature should survive termination will survive.

8. Governing law

These Terms are governed by the laws of the United States, without regard to its conflict‑of‑laws rules.

9. Changes to these Terms

We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
